These Terms & Conditions ("Terms") govern your access to and use of www.solasfunding.com (the "Site") and any services made available through it by Solas Funding LLC ("Solas Funding", "we", "us" or "our"). By accessing the Site or submitting information through it, you agree to these Terms. If you do not agree, do not use the Site.
Solas Funding LLC is an independent Florida-based Independent Sales Organization (ISO). Solas Funding is not a bank, lender, funder, broker-dealer, investment adviser or law firm. Solas Funding does not make credit, underwriting, pricing, approval, decline or funding decisions. Those decisions are made independently by third-party funding partners that conduct their own underwriting in accordance with their own criteria, policies and agreements.
Nothing on the Site is an offer, commitment or promise to provide funding on any terms. Information about eligibility, revenue thresholds, documentation or timelines is preliminary screening guidance only. It is not a pre-approval, a credit decision or a representation that funding will be offered or available.
All funding is subject to underwriting and funding-partner approval. Approved amounts, costs, terms, structures and availability vary by applicant, industry, state and funding partner, and may change without notice.
Eligibility guidelines published on the Site reflect the screening criteria Solas Funding applies at the time of publication and may be amended at any time. Certain states and industries require additional review before a submission can proceed, and certain states and industries are not eligible under current funding-partner guidelines. Being within published guidelines does not entitle any business to a submission, an offer or funding.
You represent that you are at least 18 years old, that you are authorised to act on behalf of the business you submit information about, and that all information and documentation you provide is true, accurate, complete and not misleading. You authorise Solas Funding to share that information with independent third-party funding partners and service providers for the purpose of evaluating and preparing a funding submission. Providing false or misleading information may result in a submission being withdrawn and may have legal consequences.
By submitting your contact details you agree that Solas Funding may contact you by telephone and email regarding your enquiry and any submission. Where you separately opt in to text messaging, message and data rates may apply, message frequency varies, and you may reply STOP to opt out or HELP for assistance. Consent to receive marketing text messages is not a condition of obtaining funding or of purchasing any product or service.
Content on the Site is provided for general informational purposes only and is not legal, tax, accounting, financial or investment advice. You should consult your own qualified professional advisers before entering into any funding arrangement.
Funding partners, service providers and other third parties referenced or linked from the Site are independent of Solas Funding. Solas Funding does not control and is not responsible for their products, terms, conduct, content or privacy practices. Any agreement you enter into with a funding partner is solely between you and that funding partner.
The Site and its content — including text, graphics, layouts, the Solas Funding name, the Solas Horizon logo, and the tagline "A Clearer Path to Capital." — are owned by Solas Funding LLC or its licensors and are protected by intellectual property laws. No right or licence is granted except the limited right to view the Site for its intended purpose.
The Site and its content are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy or uninterrupted availability, to the fullest extent permitted by law.
To the fullest extent permitted by law, Solas Funding LLC and its members, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to your use of the Site or our services, whether based in contract, tort, statute or otherwise, even if advised of the possibility of such damages. Our aggregate liability for any claim relating to the Site will not exceed one hundred United States dollars (US$100).
You agree to indemnify and hold harmless Solas Funding LLC and its members, officers, employees and agents from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of your use of the Site, your breach of these Terms, or information you submit that is inaccurate or misleading.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Miami-Dade County, Florida have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Site.
We may revise these Terms at any time. The effective date above indicates when they were last revised, and your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
